Policy

Thank you for signing up to one of my retreats – please read the following important terms and conditions.
This contract sets out:
• your legal rights and responsibilities;
• my legal rights and responsibilities; and
• certain key information required by law.
The contract below sets out the legal terms that will govern my relationship with you and apply to the services.  The intention of this contract is to bring clarity to our relationship, protect both parties and take care of the business side of things so that we focus on enjoying the retreat.

**1. Registration and Payment:**
  - To secure your spot, a non-refundable deposit is required through the indicated website (meetup.com).
- Upon registration you declare, you had a look at the start - end date of the retreat and made your calendar free for those days.  
- Once the deposit is paid you will be added to a WhatsApp group dedicated to the retreat members and all the communication will be held there until the start day of the retreat.
  - Full payment must be completed 30 days prior to the retreat start date, according to the agreed way between me, Nora Sike and You, the participant - payment plans will be available and listed to you through the WhatsApp Group Chat and the instalments have to be issued through direct debit link, provided by me, Nora Sike.
  - Prices DO NOT include  travel insurance or health insurance or full transfer from your city to the venue. 

**2. Cancellation Policy:**
  - Up to 90 days before the retreat: 80% refund of the total amount, deposit excluded.
  - Between 60-90 days before the retreat: 50% refund of the total amount, deposit excluded.
  - Between 30-60 days before the retreat: 30% of the total amount, deposit excluded.
  - Within 30 days of the retreat: No refund.

**3. Responsibilities:**
  - Participants are responsible for their personal belongings and any valuables brought to the retreat. I, Nora Sike, am not taking any responsibilities for lost properties or items. 
  - Participants are expected to exhibit respectful behaviour towards fellow participants, staff, and property throughout the duration of the retreat (no excessive drinking, no partying or loud music and dancing after 10PM).
- In the event of any disruptive behaviour reported or observed by other participants, I, Nora Sike, reserve the right to terminate our agreement with immediate effect and send you home. 
  - Participants are responsible for their own travel arrangements to and from the retreat location.
  - Participants are responsible for issuing their own health or travel insurance with a third party.
 

**4. Retreat Schedule:**
  - The retreat includes daily Spanish language classes by a highly qualified native teacher (6hr - 16hrs according to retreat you, the Participant, signed up for).
  - The curriculum will be provided to participants before the retreat. Nevertheless, we retain the right to modify it if Nora Sike and Victoria, the teacher, deem it necessary for the overall benefit of the retreat or the interests of the participants.
  - Physical activities such as walking outdoors and yoga may be part of the program but it is not a guarantee. 
  - Dinner or breakfast, if requested by the Participant, will be provided by the event organizer, not by a professional chef. Quality and the variety of the meals will respect the dietary requirements You, the Participant, provided me, Nora Sike, with before the start of the retreat.
  -The time of Dinner may vary, we retain the right to slight modifications. 

**5. Dietary Preferences:**
  - You declared, you have informed us of any dietary restrictions or preferences at least 30 days prior to the retreat start date.
  - While we will do our best to accommodate dietary needs, we cannot guarantee specific requests.
  -You are responsible for bringing and taking your own medication.
  -You declare you have consulted your doctor or GP and you have been informed and offered professional guidance on treatment prior the retreat about any ongoing health issues as Me, Nora Sike, do not take any responsibility nor hold any medical qualification in case of a medical emergency.

**6. Health and Safety:**
  - Participants are required to inform us of any medical conditions or allergies that may affect their participation. Failing this, you may not be able to participate in the retreat.
  - Physical activities will be tailored to accommodate varying fitness levels, but participants should assess their own capabilities, via professional channels. 
  - You are responsible to look after your own physical readiness and assess at all time even during the retreat.

**7. Indemnity**
  - You agree to fully indemnify without limitation any organiser(s), Nora Sike, trainer(s), Nora Sike, teacher(s), Victoria, or contractor(s) against any injury, malpractice, mishap, or accident during any and all interactions with the Company away from, or at the primary place of business for Our Retreat.

**8. Acknowledgment of Risks**
  - By participating in our retreat, you affirm that you are cognizant of the inherent risks associated with exercise and travel. You willingly engage in the program with full awareness of these risks.
  -You understand that we cannot offer medical advice, and any information provided is intended solely as a general guideline. 
  - If you have pre-existing health concerns or are aware of potential health risks, you accept the responsibility to consult with a healthcare professional for clearance before attending any of our retreats.

**9. Can Do / Can't Do:**
  - Participants can immerse themselves in Spanish language learning, engage in physical activities, and enjoy the provided amenities, network and enjoy the social aspect of the retreat.
  - Participants cannot engage in disruptive or disrespectful behaviour, violate local laws, or jeopardize the safety and well-being of others.
  - Participants are not allowed to play loud music after 10 PM, Party within or around the property, break or damage any part of the property and consume excessive alcohol which would entail possible out of control behaviour.
   - Participants are strictly prohibited from distributing, sharing, or making publicly available any of the teaching materials provided by Victoria, our Spanish teacher. Victoria retains all (copy) rights to her instructional materials.

**10. Amenities:**
  - Accommodation is included in the retreat package.
  - Common areas, recreational facilities, and specified amenities are available for use.
  - Any additional services or amenities not explicitly mentioned are not included.

** 11. (Travel) Insurance**
  - It is a mandatory requirement that your travel insurance comprehensively covers the activities offered during our retreat, encompassing unforeseen cancellations, illnesses, losses, and standard risks associated with travel.
  - Organizing suitable travel and health insurance is solely your responsibility. You acknowledge that Our Retreat does not provide insurance products and cannot be held accountable if your failure to secure adequate insurance coverage exposes you to medical, financial, or other risks.
  - You recognize and accept that, as a condition of booking, you must procure an appropriate travel insurance policy that includes coverage for all elements outlined in the sample itinerary for your selected Retreat. This coverage should extend to trip cancellation, and any other activities that may reasonably be undertaken during the Retreat. The insurance policy must be valid and in effect for the entire duration of your Retreat.
  - For emergency purposes, you will be required to either email or bring a copy of your insurance policy to the retreat.

**12. Cancellations Policy: Cancellations made by Us**
  - In the event that Our Retreat has to cancel or alter the Start Date of any Retreat for any reason, you have the option to transfer the funds paid to another Our Retreat trip, either one that is already scheduled or at a later date within the next two (2) years, to be utilized as credit. 
 - Alternatively, you may opt for a refund of the payments made to Us. This refund will be facilitated to the extent possible, considering any non-recoverable costs that we incurred in anticipation of your Retreat.

**13. Third Parties**
  - Our Retreat disclaims any responsibility for the actions or omissions of third parties or independent contractors. This includes situations where they alter the nature of a service on a Retreat compared to the initially advertised nature of the service.
  - Furthermore, Our Retreat assumes no liability for delayed, missed, or cancelled flights, buses, ferries, transfers, or any other modes of transportation necessary for you to reach your accommodation or participate in any activity or event related to your retreat.

** 14. Exclusions**
  - While all information presented on the website and in any written or verbal communication is accurate at the time of publication, certain factors such as mechanical faults, weather conditions, or unforeseen occurrences, often termed as 'Acts of God,' may temporarily render some amenities unavailable. On rare occasions, we may need to modify the advertised program due to issues such as staff sickness or other unforeseen challenges. In such cases, we will make every effort to offer a suitable replacement.

**15. Late Arrivals/Early Departures**
  - We do not offer credit for arriving late to Our Retreat or departing early.

**16. Team Members and Classes**
  - In the case of a team member experiencing injury, illness, or an emergency that necessitates their departure from the retreat, it may affect the planned yoga, fitness classes, or talks, leading to potential cancellations.
  - While we will make every effort to adapt to the situation and minimize the impact on your retreat experience, securing a substitute team member may not always be feasible. The retreat will proceed, but adjustments will be made to accommodate the team situation.
  - Please note that no refunds or compensation will be provided to account for changes in the team situation.

**17. Our Retreat will not assume liability for**
  - Any of the aforementioned events or other circumstances beyond our control. 
  - Loss, injury, or damage to you or your personal property.
  - Physical, medical, or psychiatric conditions that may arise during or after your retreat.
  - We strongly advise verifying that your holiday insurance policy adequately covers these and other potential contingencies.

**18. Photo/Video Release – Use of Image**
  - By participating in our retreat, you grant Our Retreat an absolute and irrevocable right, along with unrestricted permissions, to use photographic portraits, images, and videos in which you are featured.
   - These visuals, captured during the retreat, may be utilized, republished, copyrighted, etc., for commercial purposes associated with Our Retreat.
  - Through this, you release and discharge Our Retreat from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including, but not limited to, claims for libel or invasion of privacy.
  - Your agreement to be bound by and adhere to all policies and rules is implied upon booking any retreat with Us.

**19. General Waiver**
  - You are required to sign a waiver with Our Retreat at least 15 days before the scheduled Start Date of your retreat.
  - By participating in any of Our Retreat, you acknowledge that your involvement in all activities is voluntary. To the extent permitted by law, you waive any right to bring a cause of action against Our Retreat, its organiser, cook, contractors, employees, teachers and directors for any loss or damage to any person or property that may occur during an Our Retreat trip, including, but not limited to, incidents resulting in death.
  - It is imperative to disclose all health issues, including allergies, at the time of booking.
  - Our retreat is not suitable for individuals under the age of 18 or those with physical disabilities unable to care for themselves, as we lack the necessary resources and expertise. Certain areas of the retreat may be inaccessible to individuals with mobility issues.

**20. Agreement**
  - By registering for the Spanish Language Retreat, you acknowledge that you have read, understood, and agree to abide by these terms and conditions.
